NATO 3 Update

UPDATE (JAN 17th, 2013): The jury has officially been selected and the trial is set to begin Tuesday morning (January  21st) at Cook County Courthouse in Chicago.

In the days leading up to the Chicago NATO summit in May 2012, three anti-NATO activists were pre-emptively arrested after undercover Chicago cops infiltrated the Occupy movement. Co-defendants Brent Betterly, Jared Chase, and Brian Jacob Church were charged with 11 felonies, some of which were brought under the Illinois state terrorism statute. Their attorneys challenged the terrorism statute as unconstitutional on its face and as applied to this case, but the judge denied their motion to dismiss the terrorism charges on March 27, 2013. Subsequent motions to dismiss some or all of the charges have also been denied. They remain incarcerated pending trial.

Jury selection is currently underway and it has been announced that the prosecution has dropped for of the original 11 charges, leaving 7. The defendants will now be tried on the charges of material support for terrorism, conspiracy to commit terrorism, possession of an incendiary device (4 counts), and solicitation to commit arson.
